In this video Houston attorney Gregg Anderson of the law offices of Terry Bryant answers the question: Does it matter whether I was wearing a helmet? It matters; for your personal safety you would be a lot better off with a helmet than without one. The law in Texas requires use of a helmet. Although that is a general rule, there are more exceptions to it than an actual rule. In Texas, if you are 21 years old and you show proof that you have taken the motorcycle safety course or show proof of health insurance that would cover any injury you might sustain in a motorcycle wreck then you are not required to wear a helmet. That is unfortunate, because helmets do make a huge difference with regard to the extent of injuries. So we ought to have a little tighter law on that, but in Texas, we don't.
