Find the best financial services for you at: SMARTFINANCESOLUTIONS.NET - Can creditor sue us after Chapter 7? - We filed for chapter 7 bankruptcy last year and it was discharged in December of 2009. We had a water softener/filtration system that we listed as 'retain' in our court papers. Under the advisement of our attorney, we decided against reaffirming this debt and stopped paying for it. Our bankruptcy was discharged and now the water softener company is suing us for the cost of the system. The company's attorney is stating that a lien was put on the softener and because of this, they can sue us for the remaining loan. Can they sue us for the remaining balance even though the debt was discharged? We never signed a reaffirmation agreement. -
